CONSTITUTION OF
THE SCHOOL COMMONWEALTH
OF TWO TERRITORIES


passed on 20 October 1990;
amended 29 May 1993,

  1. PREAMBLE

    We, the students, teachers and parents, with a view to realize our intentions and aspirations connected with the education and bringing up of youth, hereby establish the School Commonwealth of Two Territories. It will promote knowledge, the ability to cooperate and respect for human rights.

  2. SUPREME AUTHORITIES

    2.1 The power over the School Commonwealth of Two Territories shall be exercised by the Society of Friends of the First Cooperative High School.
    2.2 The Society shall decide about the School's existence, the material foundations of its activities and the strategy of its development.
    2.3 The competences of the Society's Management Board and its Auditing Committee are specified in the Charter of the Society.

  3. THE POLITICAL SYSTEM OF THE SCHOOL COMMONWEALTH OF TWO TERRITORIES

    3.1 The School Commonwealth of Two Territories shall consist of four estates:
    - Students' estate
    - Parents' estate
    - Teachers' estate (encompassing all persons employed in the School on a permanent basis)
    - School Leavers' estate
    3.2 The estates shall all be subject to the same laws, however, owing to the different roles performed by them in the School Commonwealth, they shall have different prerogatives.
    3.3 The School as a Commonwealth shall have three kinds of power:
    - legislative power, exercised by the Parliament;
    - executive power, exercised by the Principal, the Teachers' Council and the School Councils;
    - judiciary power, exercised by the School Court of Law.

  4. SCHOOL AUTHORITIES

    4.1 THE SCHOOL PARLIAMENT

    4.1.1 The School Parliament shall consist of 63 deputies. The students, the parents' and the teachers' estates shall be represented by 20 deputies each, and the school leavers' estate by 3 deputies.
    4.1.2 The Parliament shall operate on the basis of the Rules adopted by it.
    4.1.3 The Parliament, as the legislative power, shall pass and amend the School Constitution. It shall do it by an absolute majority of votes of all its constitutional members, with at least two thirds (2/3) of them attending.
    4.1.4 The Parliament shall pass resolutions. It shall do it by a simple majority of votes, with at least a half (1/2) of the deputies attending.
    4.1.5 The right to introduce legislation shall be belong to the Principal, the School Council, the Teachers' Council, the Management Board of TP PSLO [The Society of Friends of the First Cooperative High School] and at least 15 citizens of the School Commonwealth.
    4.1.6 The Parliament shall approve the annual plan of the School's community life and shall accept a report on the plan's fulfilment.
    4.1.7 The Parliament shall organize plebiscites on issues that are vital for the School. It shall do this upon the request of at least 15 citizens of the School Commonwealth.
    4.1.8 A meeting of the Parliament shall be convened by the Parliament Speaker, upon his/her own motion, or upon the request of at least 10 deputies, at least twice a year.
    4.1.9 The Parliament's term of office shall be one year. The election to the Parliament shall be held at the turn of November in accordance with the procedure provided for in the Act on the Election of the Parliament.

    4.2 THE SCHOOL COUNCILS
    Either Territory of the School Commonwealth shall have its own School Council.

    4.2.1 The School Council of either Territory shall be composed of 14 persons. The students' estate, the parents' estate and the teachers' estate shall each be represented by 4 persons, and the school leavers' estate by 1 person. The Council shall also include, ex officio, the School's Principal.
    4.2.2 The Councils shall operate on the basis of the Rules adopted by them.
    4.2.3 Either School Council shall manage the whole of the community life of its own Territory.
    4.2.4 Either School Council shall prepare an annual plan of the School's community life and shall submit it to the Parliament for approval.
    4.2.5 Each School Council shall prepare a draft budget for that part of the School's budget which relates to its own community life, and shall submit it to the Parliament for approval.
    4.2.6 Either School Council shall implement the adopted life plan of the School and shall submit a report on its performance to the Parliament.
    4.2.7 Either School Council shall make the decisions concerning the current life of its Territory.
    4.2.8 Either School Council may apply to the TP PSLO [the Society of Friends of the First Cooperative High School] to dismiss the Principal.
    4.2.9 Either School Council may apply to the School's Council to remove a student or dismiss a teacher.
    4.2.10 The term of office of the School Council shall be one year. Elections to the Council shall be held at the turn of November in accordance with the procedure provided for in the Act on the Election of the Council.

    4.3 THE TEACHERS' COUNCIL

    4.3.1 The Teachers' Council shall include all teachers running lessons which are subject to marks' awarding.
    4.3.2 The Teachers' Council shall operate on the basis of the Rules adopted by the Council.
    4.3.3 The Teachers' Council shall decide on all essential matters in accordance with the School's development strategy adopted by TP PSLO [the Society of Friends of the First Cooperative High School]:
    - The determination and acceptance of the curriculum;
    - The determination and approval of the School's educational programme.
    - The assessment of the students' performance and their promotion.
    4.3.4 The Teachers' Council shall elect the School's Principal.
    4.3.5 The Teachers' Council may apply to TP PSLO [the Society of Friends of the First Cooperative High School] to dismiss the School's Principal.
    4.3.6 The Teachers' Council shall apply to the Principal to admit or expel a student.

    4.4 THE SCHOOL'S PRINCIPAL

    4.4.1 The Principal shall be elected by the Teachers' Council and employed by the Management Board of TP PSLO [the Society of Friends of the First Cooperative High School].
    4.4.2 The Principal shall appoint Deputy Principals and determine the scope of their duties.
    4.4.3 The Principal shall manage the current operation of the School.
    4.4.4 The Principal shall take decisions related to the employment or dismissal of teachers (after seeking the opinion of the Teachers' Council).
    4.4.5 The Principal shall take decisions concerning the admission and removal of students.
    4.4.6 The Principal shall represent the School vis-a-vis the educational authorities.

    4.5 THE SCHOOL'S COURT OF LAW

    4.5.1 The School's Court of Law shall settle disputes which may arise within the School and shall examine the legality of the School's laws and shall interpret them.
    4.5.2 The Court's structure and its code of procedure shall be regulated by separate statute.

  5. THE RIGHTS AND DUTIES OF THE CITIZEN OF THE SCHOOL COMMONWEALTH OF TWO TERRITORIES

    5.1 Every citizen of the School Commonwealth of Two Territories shall have an opportunity to influence the School's community life through his or her representatives in all elected authorities of the School.
    5.2 Every citizen of the School Commonwealth of Two Territories shall have the right to:
    5.2.1 have his or her political and religious beliefs respected;
    5.2.2 be treated with respect by the School's authorities and other members of the school community;
    5.2.3 enjoy the freedom of speech and expression. This means that nobody can be punished for an opinion presented by them, except where such opinion hurts the sense of personal dignity of another person or is presented in a vulgar manner;
    5.2.4 fully avail himself or herself of the didactic opportunities created by the School. This shall mean among other things:
    For the teacher -
    - the right to choose the contents and methods of teaching in accordance with the didactic and educational programme of the School.
    For the student -
    - the right to pursue an individual course of education;
    - the right to get credits for the whole of the curriculum envisaged for a given subject in a given school year by taking a mark-awarding exam, not later than on the day preceding the mark-awarding teachers' conference.
    5.2.5 The right to defend himself/herself. This means that each citizen of the School Commonwealth of Two Territories shall have the right to appeal against a wrongful decision issued by any of the School's authorities.
    5.2.6 The right to form a coalition. This means that every citizen of the School Commonwealth of Two Territories shall have the right to freely organize and create organizations, and the right to set up ad hoc committees for the purpose of endorsing an initiative.
    5.3 Citizens of the School Commonwealth of Two Territories shall be obliged to:
    5.3.1 comply with moral norms and cultural principles. This means that all contentious issues arising within the School should be settled in accordance with the generally accepted good customs and in accordance with the principles of ethics ensuing from the spirit of the Declaration of Human Rights;
    5.3.2 reliably fulfil the duties relevant for each of the estates. This means that, particular:
    the students shall -
    - comply with the requirements of their teacher regarding attendance and the manner of implementing the curriculum;
    - inform the teacher whenever they do not understand any portion of material.
    the teachers shall -
    - participate in the School's community life to an extent corresponding with their roles performed in the School;
    - provide individual consultation to students needing such assistance.
